Terms of Service
These Terms of Service (“Terms”) govern your access to and use of fortior-consulting.com (the “Site”), operated by Fortior LLC (“Fortior,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. The Site and our services
The Site provides information about Fortior’s digital consulting services, including paid media, data analytics, and custom AI agents, and lets you contact us or book a call.
Using the Site, submitting the contact form, or booking or attending a call does not create a client relationship or any obligation for either party to provide or purchase services. Any services we provide are governed by a separate written agreement signed by you and Fortior, such as a proposal, statement of work, or services agreement. If that agreement conflicts with these Terms, that agreement controls for the services it covers.
2. Using the Site
You may use the Site for lawful purposes and in accordance with these Terms. You agree not to:
- use the Site in any way that violates applicable law or regulation;
- submit false, misleading, or unlawful information, or impersonate any person or business;
- send spam, automated submissions, or unsolicited advertising through the Site’s forms;
- attempt to gain unauthorized access to the Site, its systems, or the accounts or data of others;
- introduce viruses or other harmful code, or interfere with or disrupt the Site’s operation; or
- scrape, copy, or harvest content or data from the Site by automated means, except as permitted by standard search engine indexing.
You must be at least 18 years old, or the age of majority where you live, to use the Site.
3. Our content and trademarks
The Site and its content, including text, graphics, design, logos, and code, are owned by Fortior or its licensors and are protected by intellectual property laws. The Fortior name and tower logo are trademarks of Fortior LLC. You may view and print pages of the Site for your own informational purposes. You may not copy, modify, distribute, sell, or create derivative works from the Site or its content, or use our trademarks, without our prior written permission.
4. Information you submit
When you submit information through the Site, you confirm that it is accurate and that you have the right to share it. Our use of personal information is described in our Privacy Policy.
Please do not submit confidential, proprietary, or sensitive information through the contact form. Information you send before a written agreement is in place is not treated as confidential unless we agree otherwise in writing.
If you give us feedback or suggestions about the Site or our services, we may use them without any obligation to you.
5. Informational content and examples
Content on the Site is provided for general informational purposes only. It is not legal, financial, tax, or other professional advice, and you should not rely on it as such.
Examples on the Site, including sample agent messages, daily briefs, business names, people, and figures, are illustrative only. They do not describe actual clients or represent actual results. Results from advertising, analytics, and AI agent services depend on many factors outside our control, and we do not guarantee any particular outcome, such as specific revenue, leads, cost per acquisition, return on ad spend, or time savings.
6. Third-party services and links
The Site links to and relies on services operated by third parties, such as our Google Calendar booking page. Your use of those services is governed by their own terms and privacy policies. We do not control and are not responsible for third-party websites or services, and a link does not mean we endorse them.
7. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, FORTIOR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FORTIOR AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you. In that case, our liability is limited to the fullest extent permitted by law. This section does not limit liability that cannot be limited under applicable law. Liability for services we provide under a written agreement is governed by that agreement.
9. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Fortior and its members, managers, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site.
10. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and Fortior consent to the personal jurisdiction of those courts. Before filing a claim, each party agrees to try in good faith to resolve the dispute informally by contacting the other for at least 30 days.
11. Changes and termination
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the effective date at the top. Your continued use of the Site after the updated Terms are posted means you accept them. We may modify, suspend, or discontinue the Site, or restrict your access to it, at any time and without notice.
12. General terms
These Terms, together with our Privacy Policy, are the entire agreement between you and Fortior regarding the Site, and they do not modify any separate written services agreement. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent, and we may assign them in connection with a merger, acquisition, or sale of assets. Sections 3 through 10 and 12 survive any termination of your access to the Site.
